Article 1 – Definition and Scope of Application
These General Terms and Conditions of Sale (hereinafter the “GTCS”) define the conditions applicable to sales concluded between, on the one hand, any person making a purchase via the website hanami-botanic.com, hereinafter referred to as “the buyer”, and, on the other hand, the company 9399-7658 Québec Inc., hereinafter referred to as “9399-7658 Québec Inc.”.
Hanami Botanic products are tabletop greenhouses and botanical compositions designed, developed, offered, and distributed by 9399-7658 Québec Inc.
Hanami Botanic products primarily include:
- Acrylic greenhouses of various shapes and sizes
- Handcrafted botanical compositions and related items
9399-7658 Québec Inc. disclaims all liability in the event that the buyer does not comply with the recommended maintenance and care conditions for the products.
Article 2 – Application and Enforceability of the General Terms and Conditions of Sale
Placing an order implies the buyer’s full and unreserved acceptance of these GTCS.
Any condition contrary to these GTCS imposed by the buyer shall, in the absence of express written acceptance by 9399-7658 Québec Inc., be unenforceable regardless of when it may have been brought to its attention.
The fact that 9399-7658 Québec Inc. does not exercise a right granted under these GTCS at a given time shall not be interpreted as a waiver of that right.
If one or more provisions of these GTCS are held to be invalid or declared as such under applicable law or by a final court decision, the remaining provisions shall remain in full force and effect.
These GTCS may be modified at any time without prior notice. The version applicable is the one in force at the time the order is placed. These GTCS apply from [update date à inscrire] and cancel and replace all previous versions. Modifications shall not apply to orders already accepted and confirmed by 9399-7658 Québec Inc.
Article 3 – Placing an Order
The information provided by the buyer when placing an order is binding. In the event of an error in the delivery address or contact details, 9399-7658 Québec Inc. cannot be held responsible for the inability to deliver the order.
Orders are considered final only once payment has been received in full.
Once the order has been shipped, no modification or cancellation may be accepted, and no refund shall be issued, except in the case of withdrawal provided for in Article 7.
Product offers are valid while stocks last. In the event of product unavailability, the buyer will be informed and may choose between:
- delivery of a product with equivalent characteristics, or
- a refund of the amount paid.
Article 4 – Product Prices
All prices are indicated in Canadian dollars (CAD).
Product prices are exclusive of delivery charges. Shipping fees are indicated before the order is confirmed.
Prices applied are those in effect at the time the order is placed. Payment is due in full at the time of order confirmation.
Prices do not include customs duties, import taxes, or brokerage fees that may apply to international orders. Such charges, if applicable, remain the responsibility of the buyer.
Article 5 – Payment Security
Payments are processed securely by credit or debit card through a trusted third-party payment provider (including PayPal).
9399-7658 Québec Inc. does not have access to and does not store any banking or credit card information. All transactions are secured using SSL encryption protocols to ensure confidentiality.
Article 6 – Delivery
6.1 Delivery Area and Methods
Delivery is available in Canada and internationally, subject to feasibility. Orders are shipped via Canada Post or other selected carriers and are subject to the carrier’s own terms and conditions.
Delivery is made to the address provided by the buyer at the time of order.
6.2 Delivery Times
Delivery times are provided as estimates only. Delays may occur due to circumstances beyond the control of 9399-7658 Québec Inc., including weather conditions, high shipping volumes, force majeure events, or inaccurate delivery information.
Exceeding estimated delivery times shall not give rise to damages or compensation.
If a product has not been delivered for reasons other than force majeure, the buyer may request cancellation of the sale and obtain a refund of the amount paid, excluding any additional compensation.
6.3 International Deliveries (United States and Other Countries)
For orders shipped outside Canada, including the United States, delivery may be subject to customs clearance procedures.
Any customs duties, import taxes, brokerage fees, or handling charges imposed by the destination country or carrier are the sole responsibility of the buyer and may be collected upon delivery.
9399-7658 Québec Inc. ships international orders on a Delivered Duties Unpaid (DDU) basis and cannot predict, control, or reimburse such charges.
Article 7 – Right of Withdrawal
The buyer has a period of seven (7) days from receipt of the order to exercise their right of withdrawal without justification, except for return shipping costs.
Returned products must be unused, in perfect condition, and in their original packaging.
Upon valid exercise of the right of withdrawal, 9399-7658 Québec Inc. will refund the buyer within fourteen (14) days of notification.
Article 8 – Returns and Claims
8.1 Commercial Warranty
In the event of an apparent defect or non-conformity confirmed by 9399-7658 Québec Inc., the buyer may obtain:
- a replacement product, or
- a credit note,
excluding any other compensation.
Returned products must be sent back within seven (7) days of receipt, unused, and in their original, intact packaging. Proof of shipment must be retained. No refund will be issued without proof of return shipment.
Article 9 – Liability
9399-7658 Québec Inc. shall not be held liable for damages resulting from improper use, handling, or maintenance of the products, nor for indirect or consequential damages.
Article 10 – Governing Law
These General Terms and Conditions of Sale are governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute shall be subject to the exclusive jurisdiction of the courts of Québec.
